“Maintaining he has ‘not done anything wrong,’ deposed president Joseph Estrada on Monday filed his Certificate of Candidacy for the country’s highest post.” Got that from Yahoo! Philippines.
In the said article, “Estrada said he is confident he could run despite provisions in the constitution that forbids a chief executive from seeking another term.” Estrada, who was ousted in 2001 via People Power and convicted of plunder in 2007, said that they have hired the services of legal luminaries, retired justices and the deans of different law schools and they said that he is ” much very qualified to run for the presidency.”
However, he noted that the provision applies to Arroyo, who will reportedly run for Pampanga Representative. I checked on what could be the basis for his statement and found this provision in ARTICLE VII Section 4 of The 1987 Constitution of the Republic of the Philippines which states: The President shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time.
Given this information, the former president was right for saying that he was qualified to run for the presidency. As he said in the article, “two years and a half lang ako” referring to his tenure. However with regards to his note that the provision applies to Arroyo, I checked on it but I couldn’t find any information (or I just didn’t know how to look) stating that the incumbent president is prohibited from running for any position. As mentioned above, “No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time.” She’ll just be running for Congress.
But whether the law states that PGMA is or is not qualify to run, in my opinion, the thing is she could use her position to her own advantage. She could use the government funds for election purposes.
Yet, in the end, it is us who will decide. I hope we have already learned our lessons. And may the good Lord bless and guide us.
